  1. Development Kit Terms of Use

    By using this development kit - evaluation board or kit (together with all related software, firmware, components, and documentation provided by Silicon Craft Technology PLC. -“SIC”, “Development Kit”), User (“You”) are agreeing to be bound by the terms and conditions of this Development Kit Terms and Conditions (“Agreement”). Do not use the Development Kit until You have read and agreed to this Agreement. Your use of the Development Kit constitutes Your acceptance of this Agreement.

  2. Ownership and Copyright

    Title to the design of Development Kit and all related intellectual property rights worldwide remains with SIC and/or its licensors. You may not remove any copyright or other proprietary rights notices on the Development Kit without prior written authorization from SIC. You agree to prevent any unauthorized copying in whole or in part of the Development Kit.

  3. Disclaimers

    1. Except as set forth above, Development Kit and any materials provided with the Development Kit (including, but not limited to, reference designs and the design of the Development Kit itself) are provided "as is" and "with all faults." SIC disclaims all other warranties, express or implied, regarding such items, including but not limited to any epidemic failure warranty or implied warranties of merchantability or fitness for a particular purpose or non-infringement of any third-party patents, copyrights, trade secrets or other intellectual property rights.
    2. Except for the limited right to use the Development Kit set forth herein, nothing in these terms shall be construed as granting or conferring any rights by license, patent, or any other industrial or intellectual property right of SIC, its suppliers/licensors or any other third party, to use the Development Kit in any finished end-user or ready-to-use final product, or for any invention, discovery or improvement, regardless of when made, conceived or acquired.
  4. Regulatory Notices

    All development kits are not certified or approved by any certified bodies. This development kit is designed to allow:

    1. Product developers to evaluate electronic components, circuitry, or software associated with the kit to determine whether to incorporate such items in a finished product.
    2. Software developers to write software applications for use with the end product.

    This development kit is not a finished product and when assembled may not be resold or otherwise marketed unless all required certifications are first obtained. The operator of the kit must operate under the radio regulation or other similar in the territory where applied.

  5. Governing Law

    This Agreement shall be governed by and interpreted in accordance with the laws of Thailand, without reference to conflict-of-laws principles. You agree that exclusive jurisdiction for any dispute arising out of or relating to this Agreement lies within courts located in Bangkok, Thailand and consents to venue in Bangkok, Thailand. Notwithstanding the foregoing, any judgment may be enforced in any Thailand or foreign court, and SIC may seek injunctive relief in any Thailand or foreign court.

  6. Warranty

    SIC warrants that it has the right to provide the Development Kit to you. This warranty is provided by SIC in lieu of all other warranties, written or oral, statutory, express or implied, including any warranty as to merchantability, non-infringement, fitness for any particular purpose, or uninterrupted or error-free operation, all of which are expressly disclaimed. The Development Kit is provided “as is”. You warrant that you understand the dangers of handling and using electrical mechanical components, systems, and subsystems. You assume all responsibility and liability for any improper or unsafe handling or use of the Development Kit by you, your employees, affiliates, contractors, and designees.

  7. Limitation of Liabilities

    In no event shall SIC be liable to you, whether in contract, tort (including negligence), strict liability, or any other legal theory, for any indirect, special, consequential, incidental, punitive, or exemplary damages with respect to any matters relating to this agreement, regardless of whether SIC has been advised of the possibility of the same. In no event shall SIC’s liability arising out of this agreement in the aggregate exceed the higher of the amount paid by you under this agreement for the purchase of the Development Kit, or ten united states dollars ($10.00).

  8. User’s Indemnity Obligations and Representations

    You will defend, indemnify, and hold SIC, its licensors and their representatives harmless from and against any and all claims, damages, losses, expenses, costs and liabilities (collectively, "claims") arising out of or in connection with any handling or use of the Development Kit that is not in accordance with these terms. this obligation shall apply whether claims arise under statute, regulation, or the law of tort, contract, or any other legal theory, and even if the Development Kit fails to perform as described or expected.

  9. Waiver/ Return Policy

    WAIVER: The waiver by either You or SIC of any breach of any provision of this Agreement shall not operate or be construed as a waiver of any other or a subsequent breach of the same or a different provision.

    Return Policy: Except as otherwise provided, SIC does not offer any refunds, returns, or exchanges. Furthermore, no return of Development Kit will be accepted if the package has been opened and no return of the Development Kit will be accepted if they are damaged or otherwise not in a resalable condition. If You feel it has been incorrectly charged for the Development Kit it ordered or that delivery violates the applicable order, You should contact SIC. All refunds will be made in full within thirty (30) working days from the return of the components(s), excluding any postage or packaging costs.

  10. Survival

    Any provision of this Agreement which imposes an obligation after termination of this Agreement shall survive the termination of this Agreement.

  11. Waste and Recycling

    The Development Kit is not to be disposed as an urban waste. At the end of its life cycle, differentiated waste collection must be followed. In the countries belonging to the European Union, the Development Kit is subject to differentiated recycling at the end of its life cycle; therefore, it may be forbidden to dispose the Development Kit as an undifferentiated waste or with other domestic wastes. Consult the local authorities for more information on the proper disposal channels and recycling centers. Disposing incorrectly the Development Kit may cause damage to the environment and it may be subject to fines based on specific countries’ rules.
